1. Introduction

Welcome to Local Tradez (“Local Tradez”, “we”, “our”, “us”).

These Terms & Conditions govern your access to and use of the Local Tradez website, mobile application, services, messaging systems, workflows, and related functionality.

By accessing or using the platform, you agree to be bound by these Terms & Conditions. If you do not agree with these Terms, you must not use the platform.

2. Platform Purpose

Local Tradez is a workflow and communication platform designed to assist homeowners, contractors, tradespeople, and service providers in:

• Scoping jobs
• Capturing job information
• Packaging project details
• Communicating with users
• Scheduling works
• Issuing estimates or quotes
• Invoicing outside the platform
• Managing workflow processes

Local Tradez does not carry out building work, maintenance work, trade services, project management, supervision, or construction services. Local Tradez is not a contractor, builder, subcontractor, certifier, engineer, consultant, insurer, or payment provider.

3. Independent Contractor Relationship

All contractors, tradespeople, service providers, and businesses using the platform operate independently. Local Tradez does not employ contractors or tradespeople listed on the platform. Any agreement for works, services, pricing, variations, scheduling, workmanship, defects, warranties, or disputes exists solely between the customer and contractor.

4. No Guarantee of Workmanship

Local Tradez does not guarantee:

• Workmanship or trade quality
• Licensing or insurance validity
• Pricing accuracy or contractor suitability
• Project outcomes or completion dates
• Compliance with laws or regulations

Users acknowledge that all works are performed entirely at their own risk.

5. Contractor Verification Disclaimer

Local Tradez may request or display ABN details, licences, insurance information, GST registration, service areas, reviews, or business details. However, Local Tradez does not independently verify or guarantee the accuracy, validity, currency, legality, or authenticity of such information.

Customers are solely responsible for conducting their own due diligence before engaging any contractor or service provider, including independently verifying licences, insurance, qualifications, permits, registrations, reviews, references, and suitability for the intended works.

6. User Responsibilities

Users agree to:

• Act honestly and in good faith
• Provide accurate information
• Comply with Australian laws
• Maintain respectful communication
• Avoid fraudulent, misleading, or unlawful conduct
• Use the platform only for lawful purposes

Users must not:

• Impersonate another person
• Upload false licences or insurances
• Misuse messaging systems or harass users
• Distribute spam or unlawful content
• Interfere with platform functionality

7. Quotes, Estimates & Pricing

Any estimate, indication, quote, budget, or pricing provided through the platform is indicative only, may be subject to change, may require site inspection, may exclude unforeseen works, and does not constitute a fixed contractual price unless separately agreed in writing between parties.

Local Tradez accepts no responsibility for quote accuracy, pricing disputes, cost overruns, scope variations, hidden conditions, or project delays.

8. Payments

Local Tradez does not process customer-to-contractor payments inside the platform. All payments for works or services occur independently between users. Subscription payments relating to platform access may be processed externally via third-party payment providers. Local Tradez accepts no liability for payment disputes, failed payments, contractor non-payment, customer non-payment, or financial losses arising between parties.

9. Messaging & Uploaded Content

Users may upload photos, videos, job descriptions, invoices, messages, schedules, and related content. Users retain ownership of their content but grant Local Tradez a non-exclusive licence to store, display, process, and use such content for workflow functionality, support, platform operation, troubleshooting, moderation, and service improvement.

Users must not upload unlawful, defamatory, offensive, misleading, copyrighted, or inappropriate material.

10. Push Notifications

The app may send push notifications relating to jobs, messages, quotes, schedules, invoices, updates, reminders, and platform activity. Users may disable notifications through their device settings. Local Tradez does not guarantee delivery of notifications at all times.

11. Account Registration & Security

Users are responsible for maintaining password security, protecting account access, and ensuring all account information remains accurate. Users are responsible for all activity occurring under their account. Local Tradez may suspend or terminate accounts for breaches of these Terms, fraudulent conduct, abuse, unlawful activity, fake reviews, or misuse of the platform.

12. Subscription Services

Certain platform features may require paid subscriptions. Subscription pricing, inclusions, postcode access, or feature availability may change over time. Failure to maintain valid payment details may result in restricted access or suspension. Unless otherwise stated, subscriptions renew automatically until cancelled.

13. Intellectual Property

All platform content including branding, workflows, graphics, terminology, software, logos, features, and user interface designs remain the intellectual property of Local Tradez Pty Ltd. Users must not reproduce, copy, reverse engineer, distribute, or commercially exploit platform materials without written permission.

14. Limitation of Liability

To the maximum extent permitted by law, Local Tradez excludes all liability for indirect loss, consequential loss, business interruption, property damage, project defects, personal injury, contractor conduct, customer conduct, financial loss, or disputes arising from platform use. Users use the platform entirely at their own risk.

15. Indemnity

Users agree to indemnify and hold harmless Local Tradez Pty Ltd, its directors, staff, affiliates, contractors, and representatives against any claims, damages, liabilities, legal costs, or disputes arising from use of the platform, breaches of these Terms, user conduct, or services performed between parties.

16. Account Deletion

Users may delete their account within the application. Local Tradez may retain certain records where required for legal compliance, fraud prevention, dispute handling, accounting, or regulatory obligations. See our Data Deletion page for full instructions.

17. Privacy

Use of the platform is also governed by the Local Tradez Privacy Policy.

18. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of New South Wales.
